The effective date of these Terms of Use is 31 January 2014.

These Terms of Use (“Terms”) apply to www.danielaubenova.com and all other websites, applications, online services, and other interactive features or downloads from Daniela Ubenova Publishing (“Publisher”) that post a link to these Terms, whether accessed via computer, mobile device or otherwise (collectively, "Sites," and individually, a “Site”).

Important! Please carefully read these Terms before using the Site, as they affect your legal rights and obligations. You agree to these Terms by accessing or using the Site. If you do not agree to be bound by all of these terms, do not use the Site.


Ownership of Site Content

Unless otherwise explicitly specified, all materials that are included in or are otherwise a part of the Site, including past, present and future versions, domain names, source and object code and the “look and feel” of the Site (“Site Content”) are owned, controlled or licensed by “Daniela Ubenova-Daniela Bilanska” with a trade name Daniela Ubenova Publishing, and are protected from unauthorized use, copying and dissemination by copyright, trademark, and other laws, rules, regulations and treaties. The Site Content may not be copied, reproduced, downloaded or distributed in any way, in whole or in part, except with the written permission of the Publisher as is expressly provided in these Terms. Any unauthorized use of the Site Content is prohibited.

Using Site Content

The Site may be visited without further permission from Daniela Ubenova Publishing. The Publisher grants you a limited, personal, non-exclusive, non-commercial, revocable and non-transferable license to download and view the Site Content, as long as you do not breach the Bulgarian Copyright Law. You may use Site Content in the mass media and social media, only if you clearly state the source.

When you download or use the Site Content, you must: (a) keep intact all copyright and other proprietary notices; (b) make no modifications to the Site Content; and (c) not copy or adapt any object code associated with the Sites or reverse engineer, modify or attempt to discover any source code associated with the Sites, nor allow or assist any third party to do so (whether or not for your benefit).

You may not use the Site for any purpose or in any manner that infringes the rights of any third party. You may not publish any content which is illegal, untruthful, threatening, misleading, harassing, abusive, scandalous, pornographic, vulgar or religiously intolerant. The Publisher may delete users’ materials at any time if the latter do not comply with the above rules.

Accuracy and authenticity of the information

The Publisher aims to maintain accurate and authentic information on the Site at all times but does not guarantee that the Site Content is completely free from mistakes and that the Site provides an uninterrupted access to its content. The Publisher will take all reasonable measures to publish accurate, timely and secure information. However, if this is not the case due to unpredicted circumstances, the Publisher cannot be held liable. The Publisher withholds the right to edit texts and images, to change their location and to cut the access to outdated information.

Registering and updating your profile. Security and confidentiality of personal data

The Site may be browsed and used without registration and entering personal data. The registration is a fast and simple process, which gives you access to special offers and services. To register you provide personal information such as name, surname, address for delivery, valid email and password (for individual clients) or name, address, VAT number, legally responsible person, telephone, invoice information, email and password (for educational institutions / businesses / organizations). You are responsible for providing correct and full data, especially in case of an order, so that the shipping and payment can be done successfully. After registering, you can log into your profile and review your latest orders. In case you lose or forget your password or username, you can request new ones to be sent automatically to the email address you have provided. Your data can be changed and/or deleted after your explicit request for this. The Publisher is not responsible for any unauthorized access to your profile, which has happened due to your sharing of your username and password with third parties. Neither is the Publisher responsible for any losses or damages due to such an unauthorized access.

In accordance with the Bulgarian Data Protection Law and EU Data Protection Directive you have the right to access and change your own personal data, which you have entered in the Publisher’s Site. By accepting these terms, you agree that the personal data you have provided in the Site can be used by the Publisher for the purposes of providing you with services you have explicitly requested and for attending to your customer needs.

The Publisher treats your personal data with utmost care and uses it solely for the purposes of providing you with services you have requested. Personal data is not shared with third parties in any form, except when the Publisher is obliged to do so under the circumstances outlined in Bulgarian law.

The Publisher is not responsible for any damages and losses due to non-compliance with the current article of the Terms.


E-commerce

The website offers products and services, which you can order and purchase. They are subject to the E-commerce terms and conditions, which are stated below and also shown before you proceed to checkout and finalize your order.


Prices

When shopping from the online bookstore of Daniela Ubenova Publishing, you agree to pay the price stated on the website at the moment of your purchase. The Publisher has the right to change the prices in the bookstore without explicitly informing you.


Shipping and payment

Shipping in Bulgaria is carried out to your door by a courier service and takes between 1-3 working days. Shipping abroad is handled by Bulgarian Posts for 7-40 working days. The costs depend on the weight of the ordered goods and their destination. The shipping fees are automatically calculated after the selection of the desired books is finalized. These costs are paid by the client, unless it is explicitly stated otherwise. The payment can be done in one of the following ways: online with a credit/debit card (Visa, Visa Electron, Mastercard, Maestro), via bank transfer or by a cash payment upon delivery. After successfully placing an order, you will receive a confirmation message on the email address you have provided.

In Bulgaria we work with courier services which deliver directly to your door in every corner of the country for 1-3 working days. The price for delivery in Sofia is BGN 3.58 up to 5 kg and BGN 7.86 between 5 and 10 kg. The price for delivery outside Sofia is BGN 3.67 up to 0.5 kg, BGN 5.04 – up to 1 kg, BGN 5.52 – up to 2 kg, BGN 6.36 – up to 3 kg, BGN 7.08 – up to 4 kg, BGN 7.92 – up to 5 kg. 1 BGN = 1.96 EUR.


To ship books abroad we work with
Bulgarian Posts, which deliver to most countries worldwide. If your desired country is not on their list, please do get in touch with us and we will find a solution. The shipping costs are calculated automatically in accordance with the official prices of Bulgarian Posts. The timeframe for delivery is between 7 and 40 working days. The Publisher withholds the right to extend this delivery period after obtaining your permission.


The Publisher withholds the right to change the shipping supplier without informing you, as long as this does not affect the final price, the method of delivery and the agreed timeframe.


Payment of ordered goods

Payments can be carried out in one of the following ways: online with a credit/debit card (Visa, Visa Electron, Mastercard, Maestro), via bank transfer or by a cash payment upon delivery.

If you choose a credit/debit card payment, you will be automatically transferred to the platform eBorica, which guarantees a secure handling of all financial transactions online.

If you choose to pay by bank, you will be kindly asked to transfer the total sum for your order to the bank account of the Publisher. The ordered goods will be delivered to you after the payment has been received. Please indicate the number of the order as a reason for payment All bank fees and commissions are to be paid by the client. If you are making a payment in a currency other than BGN, you have to transfer a sum, equal to the total amount in BGN on the day of the transaction. The same conditions described above apply in this case.

If you choose to pay by cash, at the moment of pick up/delivery you deposit the total sum for your order to the Publisher or its representative, carrying out the delivery.


Promotions, bonuses and discounts

In case of regular purchases, the registered users in the online bookstore of Daniela Ubenova Publishing receive promo codes for discounts as well as opportunities to get free books and materials from the Publisher.

Individual clients who place an order for BGN 50-100 receive 5% off the final price, which is automatically calculated online. For orders exceeding BGN 100 individual clients get 10% off. Educational institutions benefit from 22% off the cover price and free delivery when placing a group order. Wholesalers, book distributors and bookshops receive the discount agreed upon with the Publisher. In order for the discount to be applied when ordering through the online bookstore, the client needs to be registered.

For loyal clients, the Publisher offers special promo codes which can be used when ordering from the online bookstore of Daniela Ubenova Publishing. The promo codes are for a single use and are valid according to the terms and conditions under which they have been granted without including any changes in the usual rights and responsibilities between the client and the Publisher. It is possible for some products not to be covered by the promo codes.  


Right of withdrawal from ordered / purchased goods

The client has the right to withdraw (part of) their order no later than 12 hours after generating it. If a client has discovered a faulty product up to 24 hours from receiving it and if the product and its packaging are without damaged commercial looks, the Publisher takes the responsibility to replace the book/s with (a) new one(s) or to refund the client no later than 10 working days from the date when the client has exercised their right of withdrawal, in accordance with article 55 of the Bulgarian Consumer Rights Law. The product should be in a good commercial shape, without any damages, in order for the refund to take place. The shipping costs are to be borne by the Publisher.

If the books do not match the characteristics they have been ascribed with on the website of the Publisher, the Publisher agrees to refund the client no later than 10 working days from the date when the client has exercised their right of withdrawal. A condition for such a refund is the undamaged, commercially presentable state of the books. The refund, executed maximum 7 days after the Publisher receives the returned goods back, includes any delivery costs already paid by the client, in accordance with article 59, paragraph 3 of the Bulgarian Consumer Rights Law. 


Miscellaneous

The Publisher has the right to inform you about new services provided by the Site or changes in the current ones. The Publisher, however, is not obliged to inform you about any changes in the technology or the design of the website. The Publisher has the right to change the data and the Terms of the Site without notifying you in advance. They enter into force at 23:59 on the date of publication, stated in the beginning of these Terms.


Links to websites of third parties

The Site may contain links to other websites, online services and mobile applications, which are owned or administered by third parties. The Publisher does not have any control over them and does not assume any responsibility for the content, the privacy and security policies of those websites, services and applications.


Jurisdiction

All matters and complaints not settled by the current Terms, and which the parties concerned have not been able to solve by negotiations and mutual consent, are subject to the jurisdiction of the Republic of Bulgaria and should therefore be taken to the attention of the competent Bulgarian courts.
